According to the company's statistics, the number of products affected in mainland China amounts to 48.

It is understood that the children's clothing within the scope of this recall exceeds the standard value of pH and formaldehyde content, which does not meet the requirements of the national standard "pH standard of the basic safety technical specification for national textile products" (GB 18401 - 2010) and formaldehyde content limit.

High pH value in clothing can cause irritation to human skin, appear erythema, wind and itching with different degrees. Formaldehyde content is too high, which will cause clothing to release formaldehyde gradually during the wearing process. Through contact with human respiratory tract, eyes and skin, it is easy to induce other diseases.

According to the latest "unqualified information on imported industrial products" issued by AQSIQ in June 2016, the problem of imported clothing is prominent. The reasons for failure include unqualified color fastness, unqualified pH value and excessive formaldehyde content.

Among them, H&M brand chemical fiber knitted men's T-shirt imported from Shanghai by Haines Morris (Shanghai) Commercial Co., Ltd. was destroyed due to unqualified pH value, 3000 pieces. 22364 pieces of UNIQLO brand men's Denim shirts imported from Bangladesh by fast selling (China) Trading Co., Ltd. were returned due to unqualified pH value.

In addition, some clothing products of Eleven Paris, Levis, VERSACE, TOPMAN and other international brands also appeared in the unqualified list.

In recent years, some international brand clothing has repeatedly exposed quality problems.

According to the white paper issued in May 17th by the General Administration of quality supervision, inspection and quarantine in May 17th, the quality of imported clothing products in 2015 shows that the quality and safety of imported garments tested by the national inspection and quarantine is 5.87%, down by 1.62 percentage points over the same period.

From the point of view of imported clothing category, the failure rate of adult garment batch was 7.62%, up 2.22 percentage points over the same period.

Where did the unqualified list released by AQSIQ come from?

What did the blacklist do on the list? What follow-up actions did the regulatory authorities have for the disqualified manufacturers? Reporters interviewed the relevant responsible persons and industry experts.

"Clothing belongs to the general consumer goods, according to the product quality law, before entering the circulation link, there is no need for mandatory inspection."

The head of AQSIQ said, "however, the producer has the obligation to inspect the factory. It is necessary to carry out the factory inspection or entrust the third party organization to carry out the inspection, and then enter the market after being qualified."

For the international brand clothing produced in the country, how to supervise the supervision department? "We adopt the way of supervision and spot check, which is divided into two types: the state supervision and inspection by the General Administration of quality supervision, inspection and supervision, and the local supervision and inspection led by the local technical supervision Bureau."

The person in charge of the inspection of qqsiq mainly focused on the production process, and the national statutory inspection institutions carried out safety test and main performance indicators for samples according to the national mandatory standards and the company's express quality requirements.

"In the process of supervision and spot check, the quality inspection department will order rectification of the unqualified garment production enterprises, require the enterprises to find out the reasons, and continue to sell after the products are qualified.

In the course of spot checks, it is found that the quality problems of sample clothing, such as unqualified safety testing and violation of national compulsory standards, will be investigated and dealt with by the quality inspection department according to law.

The person in charge said, "for those who are particularly serious, they will be handed over to the public security organs for disposal."

At the same time, since 2009, the results of state supervision and spot checks are open to the public, and the person in charge also expressed the hope that the results of public inspection will be used to urge enterprises to rectify through social supervision.

Since 2011, the AQSIQ has imported some imported garments into the catalogue of import and export commodities that must be inspected.

At present, the catalogue mainly covers men's casual wear (shirts, T-Shirts, etc.), trousers, infants and children's clothing, clothing directly to the skin (such as underwear, pajamas, bathing suits, etc.).

The head of the inspection and supervision department of the General Administration of quality supervision, inspection and quarantine, said, "import and export clothing included in the catalogue shall be inspected and supervised by the entry-exit inspection and Quarantine Bureau (hereinafter referred to as the commodity inspection authority), which is set up by the General Administration, and shall not be sold or used without inspection."

According to the introduction, compulsory inspection includes appearance inspection and quality safety inspection.

The inspection is based on the mandatory requirements of the national technical specifications, such as the basic technical specification for national textile products (GB 18401 - 2010) and the instructions for the use of consumer goods, textiles and clothing (GB 5296.4 - 2012).

The contents include formaldehyde content, color fastness, pH value, azo, odor and product identification label.

The quality of the imported clothing products in 2015, released by the General Administration of quality supervision, inspection and quarantine, shows that from the quality and safety testing situation, 1045 items of fiber composition items failed, accounting for 54.37% of the total unqualified batches, accounting for the largest proportion of all quality and safety projects, followed by color fastness and pH value, accounting for 23.36% and 15.82% respectively, and formaldehyde projects failed to qualifying for 5.83%.

"According to the requirements laid down in the nineteenth regulation of the import and export commodity inspection law, the products that are not qualified for Chinese labels and fiber contents can be imported after rectification, and the products that are not qualified for safety and hygiene items are returned or destroyed."

For those outside the legal check list

The AQSIQ will set up a supervision and spot check plan for commodities outside the catalogue every year, and the commodity inspection authorities shall conduct spot checks on the commodities outside the catalogue according to the spot check plan.

Spot checks are based on the mandatory requirements of the national technical specifications. For the imported garments that fail to pass the inspection, they are disposed of according to the nineteenth regulations of the import and export commodity inspection law.

In recent years, the "fast fashion" brand has been popular in China, and the volume of imports has been increasing. However, the rate of failure has remained high.

Because the "fast fashion" brand has won the speed and price, some businesses have won the market by "new" and "fast" to seize the market, ignoring the quality of the products themselves, lacking strict quality control links and testing for Chinese standards.

Even if unqualified products are found, the measures such as low cost of single products, pportation or destruction will not be enough warning.

In addition, some consumers do not know enough about the hazards of the quality and safety of clothing products, so the "fast fashion" brand is still popular despite repeated exposure.

In this regard, the AQSIQ official said, "inspection of unqualified products at the port, quality inspection departments will be dealt with in accordance with the relevant provisions of the import and Export Commodity Inspection Law and its implementation regulations.

At the same time, according to the results of port inspection, we should strengthen the import control and control of unqualified brands, and use the means of responsibility interviews and consumer warnings to urge importing enterprises to strengthen the sense of responsibility for product quality and safety.

Liu Junhai, a professor at the Law School of Renmin University of China, points out that the weak punishment and low cost of illegal activities are one of the reasons for the failure of these enterprises.

According to the current product quality law, the enterprises that violate the law only impose a penalty of 3 times the value of the goods, the penalty is too small, and the operation has greater flexibility.

In addition, according to the consumer protection law, the main penalty measure for consumers to purchase unqualified products is the return of goods. For those who have committed fraud, the penalty is 3 times the amount of money they pay.

"Domestic consumers' awareness of safeguarding rights is relatively weak, so it is difficult for a single consumer to use legal rights protection, which objectively reduces the illegal cost of illegal businesses."

Liu Junhai said that in foreign countries, lawyers will voluntarily convene victims for class action for product quality problems, and illegal enterprises may face "sky high" compensation.

He suggested that the progressive establishment of class action system is one of the effective ways to solve the problem.
