Enterprises Should Have Their Own Trademark Strategy.

2007/12/6 14:09:00 41984

China's trademark law gives enterprises great freedom in the design and use of trademarks.

The current trademark law requires the trademark to be visible. However, the requirement has been abolished in the newly revised trademark law. It is allowed to apply for registration as a trademark as long as it is capable of producing any distinguishing effect and description.

This rule restored the original appearance of the trademark.

In future trademark applications, enterprises can not only apply for existing trademarks, such as graphics, text, color combinations and three-dimensional logo, but also apply single color, sound, smell and dynamic signs as trademarks.

There are no other restrictions on the application of the trademark in terms of qualification and procedure.

At the beginning of this year, the Trademark Office restricted and standardized the application of trademarks by natural persons. Natural persons applying for trademarks should not only have qualification requirements and use intentions, but also must provide proof of their ability to use them.

The necessary restrictions on the application of trademarks by natural persons will help to standardize the development of trademarks, and crack down on trade mark dealers, which is a good thing for enterprises.

The current trademark law does not clearly stipulate the time limit for examining trademark applications, usually from 18 months to 24 months, or even longer. However, the revised draft specifies the time limit for trial, and requires the Trademark Office to complete the hearing within 12 months from the date of accepting the application.

This is also good news for enterprises.

In the market economy, trademark has already surpassed the enterprise itself and created huge market value.

In reality, many consumers only know a brand product, but they do not know which manufacturer they are, unless the firm's trade name and trademark are the same.

There are too many examples.

You know the shampoo of rejoice, Head and Shoulders, PANTENE, but how many people know which factory they are producing?

How many people know that they are produced by a factory?

Therefore, trademarks have great vitality.

Although its survival and development depended on the enterprise initially, it was relatively independent from the enterprise.

Many enterprises are no longer in existence, and the products have disappeared, but people can still remember the brand names when they are in the scenery.

The influence of trademark on enterprises is extensive and the scope is wide. Trademark has already had a kind of corporate culture function and incorporated into corporate culture.

Therefore, an enterprise with long-term development should have its own trademark strategy, which is one of the reasons.

Trademarks not only increase the reputation or reputation of enterprises, but also bring huge profits to enterprises.

Trademarks are independent of their commodity manufacturers. Consumers recognize this commodity because their trademark logo is no longer a specific production enterprise, which makes many well-known trademarks of goods being produced and sold in the world possible and reality.

The most typical example is "Nike" sneakers.

Nike has long lost its original factory, but Nike trademark has created numerous processing factories for Nike trademark owners worldwide.

Trademark investment is a strategic behavior of high return.

This is the reason why enterprises implement trademark strategy two.

In China, the market value is one billion, and billions of trademarks are many, and the tangible assets of those enterprises, such as equipment, factories, land and so on, are far from being worth this value.

The value of an enterprise is actually the value of intangible assets, and trademarks should be an important part of intangible assets.

Now many financial institutions increase the trademark pledge loan business, a valuable trademark can also bring very practical benefits to enterprises.

This is also based on the intangible value of trademarks.

Of course, there are not many such businesses in China, but we have reason to believe that such businesses will be more and more.

Enterprises invest in trademarks, which will increase the value of enterprises. This is the three reason.

In China, trademark protection is the principle of registration protection. Only registered trademarks have exclusive rights.

Although the new draft has recognized the legal rights and interests of the trademark that used first and has a certain reputation, its protection is far different from that of the registered trademark.

Market economy is a legal system economy. Only the right of legal protection can have stronger vitality. Therefore, enterprises should first register their trademarks.
